Standard Terms and Conditions for Access to Port Facilities at Port Kembla

NSW Ports, the private operator of Port Kembla is introducing Standard Terms and Conditions for Access to Port Facilities (‘Access T&Cs’) as attached that are applicable to the land, channels and facilities owned, managed, or controlled by NSW Ports including, where applicable, the Common User Wharves and Dedicated Facilities.

The Access T&Cs set out the obligations and responsibilities which apply to persons accessing, using, or occupying any of the Port Facilities including:

• compliance with Legislative Requirements, Port Rules, Port Guidelines and directions given by NSW Ports;
• work health and safety obligations, incident notification and emergency access.
• environmental obligations relating to hazards, contamination, storage of dangerous goods, pollution incidents and clean up.
• security requirements.
• maintenance and repair of facilities, plant, and equipment.
• obligation to ensure that works are carried out by suitable persons in accordance with any consent or approval given by NSW Ports;
• co-operation with NSW Ports and other port users;
• obligation to ensure persons do not obstruct or cause interference to NSW Ports or other port users;
• insurance requirements
The Access T&Cs are effective from Monday 14 August 2023.
