Port charges to rise

NSW Ports will apply a CPI based increase of 4.2% for all published port charges at Port Kembla, including wharfage, site occupation and navigation charges, from 1 July 2024.

Accordingly, the Navigation Service Charge for coal and iron ore ships calling at the Coal Terminal and BlueScope Berths (presently $1.01/GT) will increase to $1.06/GT.

NSW Ports will continue the Environmental Incentive Scheme (EIS).

Further, NSW Ports has reviewed and updated its standard terms and conditions (T&Cs) for channel access and berthing at common user wharves and dedicated facilities. The updated Standard T&Cs, which will apply to all vessels that have an access period commencing at or after midnight on 1 July, have been updated to:

  • expressly make the shipping agent a party to the Standard T&Cs, with joint and several liability for the obligations of the customer (clause 1.1 and 1.3);
  • clarify that each time a vessel accesses, occupies or uses a Common User Wharf or Dedicated Facility or enters a Channel, a separate (or “spot”) agreement is entered (clause 1.1);
  • confirm that the customer has authorised the shipping agent to act as its agent (clause 1.4);
  • outline the specific obligations of the shipping agent (clause 3.2);
  • confirm NSW Ports’ legal rights in respect of detention and arrest of vessels (clause 8.1);
  • streamline the drafting of the indemnity, release and limitation of liability provisions (clauses 10 and 11 in the Channel Access T&Cs and clauses 11 and 12 in the Berthing T&Cs).
